User terms
TRAAGELDAJA OÜ, registration code 10426065, VAT payer code EE100475182, address: Viljandi mnt. 17, 79201 Käru, Järvamaa (hereinafter referred to as the Store Manager) and the client who places an order in the online store managed by Traageldaja OÜ at http://WWW.SIKSAK.EE and identifies themselves by entering their personal data in the order (hereinafter referred to as the Client), have agreed on the following terms and conditions:
1. General Provisions
1.1. The parties shall regulate their mutual relations based on the laws and other legal acts of the Republic of Estonia and the agreements stipulated in the Terms of Use.
1.2. The Store Manager has the right to make changes to the services offered in the E-store at any time.
1.3. The Store Manager has the right to unilaterally change the terms of the user agreement without the obligation to notify the Client in writing via email.
2. Products and Making Purchases
2.1. All displayed products may not always be in stock.
2.2. If a product is out of stock and the order cannot be fulfilled, the E-store employee will contact the Client within 3 (three) working days. In such a case, a new possible delivery time or a replacement product of the same price and quality will be offered. If the Client does not agree to the new conditions, they may cancel the order, and the money already paid will be refunded.
2.3. The product descriptions in the E-store may not be exhaustive and may contain unintentional errors.
2.4. The Client, who selects the desired products, undertakes to enter the required information (surname, first name, contact phone, email address, delivery address, postal code, payment method) necessary for order fulfillment.
2.5. The Client undertakes to provide accurate information necessary for fulfilling the order. The Store Manager is not responsible for the non-fulfillment of the order or any consequences resulting from the incorrect information provided by the Client.
2.6. Depending on the composition of the fabric, pattern, or the size of the pre-woven coupon, the dimensions of tablecloths and napkins may vary by ±2-4% from the stated size.
3. Prices
3.1. The base prices of all products in the E-store are calculated in euros and include 20% VAT.
3.2. The Store Manager has the right to change the displayed prices at any time.
3.3. The prices of products sold in the online store are indicated next to the products. The price includes the cost of delivery. For all orders over 50 euros, delivery to the selected parcel machine is free. Free delivery does not apply to courier delivery.
3.4. The delivery cost depends on the buyer's location and the delivery method. The delivery cost will be displayed to the buyer when placing the order.
3.5. If the Store Manager has changed the prices in the E-store after the user has placed and paid for the order, the respective products will be delivered to the Client at the prices valid at the time of the order. The Client is not entitled to claim compensation for the price difference.
4. Delivery Time and Conditions
4.1. Orders placed in the E-store are reviewed on the same day, and if necessary, the buyer will be contacted no later than the next working day.
4.2. The guaranteed delivery time for products is 5 working days plus delivery by the chosen courier company unless otherwise stated next to the product. Generally, the delivery time of the product is less than 3 working days. If we cannot deliver a product within 5 working days, we will inform the Client immediately. If necessary, the Client has the option to cancel the order, and the money will be refunded to the Client.
4.3. The goods will be delivered to the delivery address entered in the order at the agreed time according to the availability of the goods. The goods will only be handed over to the buyer. The goods will only be handed over to a third party with the buyer's agreement.
4.4. The Client has the right to choose between the following delivery methods:
1. Omniva Postal Package
2. SmartPosti Postal Package
3. DPD Parcel Shop Postal Package
4. DPD Courier Package
5. Placing an Order
5.1. To order goods, the desired products must be added to the shopping cart. To place an order, the required fields must be filled in, and the preferred delivery method selected. The total cost will then be displayed on the screen, which can be paid via bank link or other payment solutions.
5.2. The contract comes into force from the receipt of the payable amount in the Web Store’s account.
5.3. If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be notified as soon as possible and the paid money (including delivery costs) will be refunded without delay, but no later than within 14 days of sending the notice.
6. Withdrawal from the Agreement before the Store Manager’s Performance
6.1. If the Client wishes to withdraw from the agreement after placing the order and before the service provider’s performance, they must notify the Store Manager as soon as possible in writing. The written notice must be sent to the email address info@siksak.ee or by calling +372 5114 712. The email must include the order number from which they wish to withdraw and the Client's contact details (first name, surname, order date, contact phone).
6.2. If the withdrawal notice reaches the service provider after the Store Manager’s performance, the withdrawal from the agreement will take place in accordance with the chapter “Right of Return” in the Terms of Use.
6.3. The Store Manager will refund the amount paid to the Client no later than 14 days after receiving the withdrawal notice.
6.4. The money will be transferred to the same account from which it was received by the Store Manager.
7. Right of Return
7.1. After receiving the order, the buyer has the right to withdraw from the agreement concluded in the E-store within 14 days without providing a reason [depending on the products, the buyer may not have the right to withdraw; such products and services must be listed and must comply with the conditions listed in § 53 (4) of the Law of Obligations Act].
7.2. The 14-day right of return does not apply to goods made according to the Client's personal needs, not ordered according to the standard measurements given in the online store (e.g., curtains, bedspreads, tablecloths ordered according to personal measurements).
7.3. The right of withdrawal does not apply if the buyer is a legal entity.
7.4. To use the 14-day right of return, the ordered goods must not be used in any other way than necessary to ascertain the nature, characteristics, and functioning of the goods as is allowed for testing goods in a physical store.
7.5. If the goods have been used for any purpose other than necessary to ascertain the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Web Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
7.6. To return the goods, the Web Store must be notified of the wish to return via email: info@siksak.ee or by phone: +372 511 4712. The email must include the order number from which they wish to withdraw and the Client's contact details (first name, surname, order date, contact phone). Alternatively, a declaration of withdrawal from the purchase of the goods, the form of which can be found here: withdrawal form, should be sent to the email address info@siksak.ee no later than 14 days after receiving the goods.
7.7. The cost of returning the goods is borne by the seller.
7.8. The buyer must submit the request for return within 14 days of receiving the goods or provide proof that they have handed over the goods to the carrier within the aforementioned period.
7.9. The Web Store will refund the buyer without delay, but no later than 14 days after receiving the returned goods, all fees received from the buyer under the contract.
7.10. The Web Store may refuse to make refunds until it has received the goods that are the subject of the contract back or until the buyer has provided proof that they have returned the goods, whichever occurs first.
7.11. If the buyer has expressly chosen a delivery method that is different from the cheapest standard delivery method offered by the Web Store, the Web Store is not obliged to refund the cost that exceeds the cost associated with the standard delivery method.
7.12. The Web Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been mistakenly marked significantly below the market price of the goods.
8. Returning Goods via Parcel Machine
8.1. After receiving the order, the buyer has the right to withdraw from the agreement concluded in the E-store within 14 days without providing a reason.
8.2. The cost of returning the goods is borne by the seller.
8.3. When returning goods via the Itella SMARTPOST courier company:
Using the Smartpost blue parcel machine, the free return code valid for 14 days can be used with the locker code received in the same SMS as the one with which the package was received.
Using the Smartpost white parcel machine, the Web Store must be notified of the return request via email at info@siksak.ee within 14 days, and a return code will be sent to the Client separately in a new SMS.
8.4. When returning goods via the OMNIVA courier company, use the free return code valid for 14 days, which was received in the SMS when the package arrived.
9. Personal Data and Its Use
9.1. The user gives clear and informed consent to the Store Manager for the processing of their personal data.
9.2. The personal data entered by the user when placing an order, which becomes known to the service provider, will be entered into the customer register and used to provide the sales service and offer goods to the Client.
9.3. The source of personal data is the establishment of a client relationship when registering an order in the E-store.
9.4. The registered personal data includes information about the Client's order (surname, first name, street, house, apartment number, settlement or city, postal code, phone number, delivery method, payment method used). Agreement to the E-store Terms of Use includes consent to receive sales offers at the email address provided, and any comments entered in free text.
9.5. Personal data necessary for delivering goods to the Client may be forwarded to companies providing courier services.
9.6. The Store Manager undertakes not to forward registered personal data to third parties.
9.7. The Store Manager reserves the right to forward user data if it is forwarded to a person who processes the data for the fulfillment of an obligation provided by law and who has the legal right to do so, or if it is done to protect the life, health, or freedom of the Client or another person.
9.8. The Client has the right to inspect, modify, or delete their personal data from the register.
9.9. The user gives the Store Manager consent to send an order confirmation to the email address provided when placing the order.
9.10. The user gives the Store Manager consent to send newsletters and sales offers to the email address provided when placing the order only if they have indicated consent by ticking the relevant box on the order form.
9.11. The buyer can unsubscribe from receiving offers and newsletters at any time by notifying us via email or following the instructions provided in the promotional email.
10. Terms of Use
10.1. Familiarity with the terms of the Terms of Use is mandatory for the Client.
10.2. By ticking the box "I agree with the terms of use of the store and comply with them unconditionally" when placing an order, the Client confirms that they have read, understood, and agree with the terms of the Terms of Use.
11. Right to File a Complaint
11.1. In the case of defective goods, the consumer has the right to file a complaint with the seller in any form within two years from the date of delivery of the goods. The complaint must be submitted immediately, but no later than within two months of discovering the defect, by emailing: info@siksak.ee or calling: +372 5114712.
11.2. To resolve later issues, the consumer must prove the purchase with a receipt, invoice, bank statement, or another document that shows the time and parties of the transaction, proving that the goods were purchased from Traageldaja OÜ's e-store. Without a sales document, the seller may refuse to resolve the issue.
11.3. A complaint can be made about manufacturing and material defects.
11.4. The right to file a complaint starts from the date of receipt of the goods.
11.5. The costs of expertise in the first year are borne by the Web Store, regardless of who is at fault for the defect. During the remaining second year, the Web Store is not obliged to prove the nature of the defect. The obligation to cover the costs of expertise during the remaining second year lies with the Web Store in the case of a manufacturing defect or another deficiency resulting from the non-fulfillment of the Web Store's obligation, and with the consumer in the case of defects caused by misuse.
11.6. The expertise is performed by Traageldaja OÜ or the company that manufactured the product to determine the presence and cause of the defect.
11.7. Independent expertise - additional paid expertise performed by an independent expert at the request of the client if the client is not satisfied with the results of the expertise performed by Traageldaja OÜ.
11.8. The complaint will not be resolved if Traageldaja OÜ proves that the defects in the goods were caused by the consumer.
11.9. If the production of the product on which the complaint is based has been discontinued, Traageldaja OÜ reserves the right to replace the product with an equivalent one with the client's consent.
11.10. The Web Store is not responsible for defects that occurred after the goods were handed over to the buyer.
11.11. If the goods purchased from the Web Store have defects for which the Web Store is responsible, the Web Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Web Store will refund the buyer all fees associated with the sales contract.
11.12. The Web Store responds to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.
12. Procedure for Handling Complaints
12.1. If the buyer has complaints about the Web Store, they should send them via email to: info@siksak.ee or call: +372 5114 712.
12.2. If the buyer and the Web Store cannot resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority for disagreements.
12.3. The terms of procedure can be reviewed and the application submitted HERE.
12.4. The competence of the Consumer Disputes Committee includes resolving disputes arising from contracts concluded between the buyer and the Web Store. Reviewing the buyer's complaint in the committee is free of charge.
